Applicability & Conditions
Our general terms and conditions apply to every offer from us as a (Web) retailer to you as a Consumer (any natural person who, exclusively for non-professional purposes, acquires or uses products or services placed on the market).
We only deliver in Belgium and the Netherlands. If you provide a delivery address in another country, we may refuse your order.
Placing an order on the website constitutes express acceptance of our general terms and conditions of sale, which are always available via the website.
If an offer has a limited period of validity or is subject to certain conditions, we will explicitly state this in our offer.
Offer and order
We always describe as completely and accurately as possible what we sell you and how the ordering process will proceed. The description is in any case sufficiently detailed to allow you to make a good assessment. If we use images, these are a true representation of the goods and/or services offered. However, to err is human and if we have clearly made a mistake, we are not obliged to deliver to you after all.
Your order is complete and the agreement between us is final once you place your order online or via email and once we have received approval from the card issuer for your payment transaction with credit or debit cards. We accept payment via our online payment platform Mollie. If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
To purchase a product, add the product to your shopping cart. You always enter your contact details and/or billing details. Upon payment, your purchase is final.
When placing your order, you should check your own address thoroughly. Errors in the address provided are at your expense as a customer. If an order is returned to us due to an incorrect or incomplete address provided by you as a customer, a fee of 6.00 euros will automatically be charged to resend the package to your correct address.
Both for the refund and when the package needs to be resent.
Even if your package is not collected at the post office, you as a customer must pay a fee of 6.00 euros for resending or cancelling your package.
Right of withdrawal
If you purchase goods or services from us, you have the right to decide that you do not want to keep the goods within 14 days from delivery. You can then return your order without paying a fine and without giving a reason. Within 14 days after we have received your order back or you have indicated that you want to cancel the agreement, we will refund you the full purchase price by means of a bank transfer.
Returning goods will cost you €2.99 (in Belgium and excluding discounted items). This means that we will cover half of the return costs. You must submit a return request within 10 calendar days of receipt by email to info@bylenz.be stating your order number and the product in question. Only then are you entitled to this advantageous return service. For every request for sales purchases or for non-sales purchases from the 11th to the 14th day, the direct and full costs of returning the goods are at your expense. We will indicate what the cost price is or make an estimate, if this cannot reasonably be calculated in advance.
When returning SALE or discounted items, any return costs/shipping costs are always entirely at your own expense. Here, our intervention in the cost price is void.
We will wait with reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
During the first 14 days after delivery, we expect you to handle the order and packaging with care. If you still want to be able to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep them. Returned goods may be tried on, but may not be used. If you return the goods, this must be done, if possible, together with the original packaging, with all accessories supplied and in the original condition and packaging and taking into account our instructions below.
You can return your return package by post or by bringing it to our store.
To exercise your right of withdrawal quickly and correctly, please send an email to info@bylenz.be.
We will send you an acknowledgement of receipt of your cancellation by email.
The price
During the period we mention in our offer, our prices will not change, except for price changes due to changes in VAT rates.
Our prices include all taxes, VAT, duties and services. So you will never be faced with surprises. We can decide to charge shipping costs on top of the purchase price. In that case, we will always report this before you finally place your purchase.
Payment
We can only accept payment via the payment modules on our website.
To ensure secure online payment and the security of your personal data, transaction data is encrypted.
Conformity and Warranty
We guarantee that our goods are in accordance with your order and meet the normal expectations that you may have of them, taking into account the specifications of the product. We also guarantee that our goods meet all laws existing at the time of your order.
In addition, we apply the statutory minimum warranty period of two years with regard to the delivery of goods if the goods do not conform to the order placed. This means that in the event of defects or faults to the goods up to 2 years after delivery, these goods will be repaired or replaced free of charge.
To the extent possible and reasonable, you have the choice between repair or replacement. Only if repair or replacement is excessive or impossible or cannot be carried out within a reasonable period, you have the right to demand a price reduction or the termination of the sales agreement.
If the defect or fault manifests itself within 6 months of delivery, it is deemed to have already existed before delivery, unless we can prove the contrary. After 6 months you will have to prove that the defect was already present upon delivery.
This legal guarantee obviously only applies to defects that were there from the start, and not to wear and tear, clothes that you washed incorrectly, a snag because you got caught on something, etc.
This guarantee also has nothing to do with the right to exchange. We will decide whether a garment that is eligible for this legal guarantee should be repaired or replaced.
Delivery and execution
All goods and services are delivered as entered in the order.
Except for exceptions, which will be mentioned upon delivery, the purchased products will be shipped by us within 2 working days after ordering and payment. The shipping period is 1 to 2 working days. We therefore guarantee delivery within 5 working days, but in practice it will be faster.
LENZ BV determines which transport company will deliver the goods purchased by the buyer.
If we are unable to deliver on time, we cannot be held liable.
Our shipments are always at our risk. So you don't have to worry about goods getting lost in the mail. However, if you return goods to us within 14 days of purchase because you prefer not to keep them, you are responsible for the transport.
If the goods delivered by us were damaged during transport, do not correspond to the items stated on the delivery note or do not correspond to the items you ordered, you must report this as soon as possible and certainly within 3 days and return the items to us within 14 calendar days of receipt.
We cannot be held responsible for any consequential damages due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases is limited to the value of the items that are shown not to have been received by the customer.
Gift vouchers, discount codes and promotions
Gift vouchers are valid for 1 year, both in our online store and in the physical store.
If the purchase price of the product is lower than the value of the gift voucher, LENZ BV will send a new gift voucher equal to the value of the difference. The validity of this gift voucher is equal to that of the first gift voucher issued.
If the purchase price of the product is higher, additional payments are required.
Discount codes, promotional vouchers and other temporary discount options are only valid for the period stated here. The value of the goods must at least correspond to the amount of the code or voucher. They may not be combined with other discounts or transferred to third parties (registration in the name is therefore a condition for issue). They are also not necessarily valid in physical stores. A cash amount can never be paid out and the discount will never be refunded in the event of an exchange or return.
Discount codes, promotional vouchers and other temporary discount options can be combined with a gift voucher, which is considered a regular means of payment.
In case of loss, theft or illegibility of both the discount code/action voucher and gift voucher, the responsibility always lies with the consumer. Also spelling errors in the e-mail address of the consumer do not bind LENZ BV to anything
It is of course not permitted to multiply, modify or manipulate discount codes/promotional vouchers and gift vouchers.
